Overview
This is a legal document ("Agreement") which sets out your rights and obligations, and those of the Anguilla National Trust ("the National Trust", "we" or "us"), in relation to this web-site (the "Site"), and the material of all types that you gain access to on and through the Site ("Content"). We have a separate privacy policy which governs our use of your personal information.

You affirm your assent to the terms of this Agreement every time you access any part of the Site or make use of any of the Content.

Intellectual Property
The term "Content" includes, but is not limited to, all text, graphics and images which appear on the Site, and the design, look and feel of the Site itself. Each item of Content is protected by copyright and other intellectual property rights which are either owned by the National Trust or licensed to it by a third party. Where downloads of third party software are made available on the Site, they are owned by the third party licensor in question, and will be subject to any terms and conditions applied by the relevant third party. The Site may contain proprietary notices (such as moral rights and trade mark notices) and copyright information, the terms of which must be observed and followed.

Use of Content
We permit you to use the Site and its Content for the purposes for which it is intended on an individual computing device having a single central processing unit. You may download to a local hard disk and print extracts from the Site. You are not otherwise entitled to copy, distribute or transmit any of the Content, or to incorporate any of it into any website (except by way of linkage in accordance with Linking to the Site below) or other work whatsoever, nor may you broadcast, publish or facilitate any public performance of Content.

Accuracy of Content
The Site and its Content is provided for your general information only; we advise that Content may not be accurate and complete. Therefore you should not propose to do, or refrain from doing, something in reliance upon Content you find on the Site, without first checking the accuracy of the relevant Content by some other means. For example, if you propose to establish an itinerary based on opening times for, or distances to, any of the National Trust properties, you must check information of that type you obtain on the Site with the relevant properties themselves. All such information on this site is necessarily subject to change, sometimes at short notice.

Linking to the Site
We encourage businesses and others to link their sites to the Site. However, if you wish to establish a link to the Site or any of its Content, we require that the link does not open within a frameset from another web site.

Links from the Site
The National Trust is not responsible for the content of third party sites linked to the Site. They are independent of the National Trust, and their content is not endorsed or approved by the National Trust, even where the third party in question is stated to be a "partner" of the National Trust. If you agree to purchase goods or services offered on or through those third party sites, such as (but not limited to) travel bookings, merchandise and services, the resulting agreement will be entirely between you and the relevant third party; we will not be involved in, or have any responsibility under, those agreements.

Community Activity
In parts of the Site you may be enabled to interact with other users or with the National Trust, through (for example) message boards and email. You agree that any such interaction by you or through your email address will not (a) be capable of infringing the intellectual property or other rights of any person or entity, (b) breach any applicable law, whether criminal, tortious or otherwise, or (c) be offensive, obscene, pornographic, insulting, false, unreliable or misleading. You also agree that we may remove any postings or other interaction in our entire discretion.

Personal information
You may provide certain personal details to us when you register for the Site, such as your name, your email address, and your geographic address. We will use this information in accordance with our privacy policy.

Changes to this Agreement
If we make any changes to this Agreement, your use of the Site any its Content following the date of that change will be governed by the changed Agreement.

Liability
Your attention is brought to the paragraph headed Accuracy of Content above and you are reminded that the National Trust considers following the advice in that paragraph to be an obligation on your part in respect of your use of this site. The National Trust will not be liable for losses that were not forseeable to both parties when the contract was made; or for losses that were not caused by any breach on the part of the Trust; or for business losses and/or losses to non-consumers. Nothing in this Agreement limits the National Trust's liability for death or personal injury resulting from the National Trust's negligence.

Territory and Laws
The Site is provided from Anguilla for access and use by people both there and elsewhere. If you visit the Site from outside Anguilla, you are, in effect, visiting the territory of Anguilla. Accordingly, you acknowledge that the laws of Anguilla apply to your use of the Content and govern this Agreement, and that the National Trust takes no responsibility to ensure the conformance of the Content or the Site to your country’s laws.

Effect of Agreement
The National Trust intends to rely upon the written terms set out here. If you require any changes, please make sure you ask for these to be put in writing. In that way, we can avoid any problems surrounding what the National Trust and you the Customer is expected to do.



PRIVACY
We believe strongly in protecting users' privacy. This statement describes the privacy practices for the National Trust's web sites:

Information gathered on registration
Certain parts of our Site require you to register before you can access them. Our registration forms request that you give us certain information which personally identifies you.

We will use the information which you provide to fulfil your request, order or enquiry.  We may contact you in the future about some other aspect of your work, but if it is your wish that we do not, please  let us know by ticking the appropriate box, or by contacting us at the address below.  If you are a  member of the National Trust we should already be aware of your mailing preferences.

At the National Trust we take our responsibilities under the Data Protection Act very seriously.  As well as a legal requirement, this is an important customer service issue.  If at any time you believe we have contacted you inappropriately, please let us know.

Sharing and international transfer of information
We will not provide any of the personal information you give to us to any third party, except with your prior express consent.

We will retain the personal information you provide within the Anguilla, and will not transfer it to any other country, except with your prior and express consent.

Security
The National Trust is committed to the security of users’ personal information and we have security procedures in place to protect the loss, misuse or alteration of information under the National Trust's control. We have security measures in place to protect our user database and access to this database is restricted internally.

Links to third party sites
Our site contains links to other sites. The National Trust is not responsible for the privacy practices, or the content, of those web sites. If you have followed a link from the National Trust website to another website you may then be supplying data directly to a third party yourself.
